Summary Minutes: Regular City Commission Meeting September 17, 2015 City of Sunny Isles Beach, Florida <br />Mayor Scholl said this actually helps the homeowner, and he is a single- family homeowner, <br />because the wall will be proportionate to your yard as opposed to if the crown of the street is <br />lower and your house is elevated; you could end up with a little wall. Years ago when he put <br />up his wall, he had to get a variance in order to have the wall. <br />Commissioner Goldman moved and Commissioner Levin seconded a motion to approve the <br />proposed Ordinance on first reading. The motion was approved by a roll call vote of 5 -0 <br />in favor. An Ordinance of the City Commission of the Cite of Sunny Isles Beach, Florida, Amending <br />Section 265 -35 of the City Code Entitled "Mixed Use Resort (MU -R)" Zoning District <br />to Permit an Elevated Pedestrian Bridge Between Towers on the Same Lot; Providing <br />for Severability; Providing for Repeal of Conflicting Provisions; Providing for Inclusion in <br />the Code; and Providing for an Effective Date. <br />Action: Citv Clerk Hines read the title. and Planning and Zoning Administrator Claudia <br />Hasbun reported. This Ordinance permits an elevated bridge up to 35 feet from the ground to <br />connect condominium towers on the same property for the purpose of sharing amenities. <br />Public Speakers: None <br />Mayor Scholl explained that every once in a while we have nuances in our Code that favors a <br />particular property. In some cases if you own two lots you get special treatment but if you <br />own a lot that is beside the two lots you get penalized because of the way the Code is written. <br />This is one of those instances where we have an ordinance that says; as with Acqualina, you <br />can build a bridge between two towers if you own the adjacent lots. We have an instance <br />coming up where we have a developer who owns a lot and he is going to build two towers but <br />he can't put a bridge between the two towers. It doesn't make a lot of sense to make him have <br />to do a lot split just to be able to build a bridge to meet our Code. Commissioner Aelion said <br />if we have a situation where a developer wants to modify an existing approved site, and Ms. <br />Hasbun said if they want to modify the bridge, the height has to meet Code requirements. <br />Commissioner Aelion moved and Vice Mayor Gatto seconded a motion to approve the <br />proposed Ordinance on first reading.
