ORDINANCES FOR SECOND READING (Public Hearings) Sitting in as the Local Planning Agency and the City Commission, to Consider the Following Ordinances Amending the Land Development Regulations (LDRs): 9A. A Resolution of the Local Planning Agency of the City of Sunny Isles Beach, Florida, Recommending to the City Commission of Sunny Isles Beach, the Ordinance Amending Section 265 -46 of the City Code to Clarify that Off - Street Loading Spaces Shall be Required for All Commercial and Office Buildings: Providing for an Effective Date. Action: [City Clerk's Note: Items 9A and 9A.1 ix,ere heard together.] City Clerk Hines read the title, and Planning and Zoning Administrator Claudia Hasbun reported. Commissioner Aelion moved and Vice Mayor Gatto seconded a motion to approve the resolution. LPA Resolution No. 2015 -91 was adopted by a vote of 5 -0 in favor. 9A.1 An Ordinance of the City Commission of the Cite of Sunny Isles Beach, Florida. Amending Section 265 -46 of the City Code Entitled "Off- Street Parking and Loading Standards" to Clarify that Off - Street Loading Spaces Shall be Required for All Commercial and Office Buildings; Providing for Severability; Providing for Repeal of Conflicting Provisions: Providing for Inclusion in the Code; and Providing for an Effective Date. (First Reading 07/16/15) Action: City Clerk Hines read the title, and Planning and Zoning Administrator Claudia Hasbun reported that we had an exception that if building office was less than 5,000 square feet they did not have to provide a loading area within their property. This will make any office that is less than 5.000 square feet to provide a loading area within their property. Public Speakers: None Commissioner Levin asked why subparagraph (e) was deleted, and Ms. Hasbun said that was to make it consistent, if you have a commercial building then you would not have to add that. Vice Mayor Gatto said she really likes this Ordinance. and she thanked Commissioner Aelion for spearheading it. Mayor Scholl said we had an issue with trucks stopping on Collins Avenue and other streets to load and unload, which has been a constant problem for us. Commissioner Aelion said he gives a lot of credit to our Code Enforcement Officers. Commissioner Aelion moved and Vice Mayor Gatto seconded a motion to approve the Ordinance on second reading.
