Acceptance and use of such areas by the Owner shall not waive any other provisions of
this Contract.

1.15

A. Contractor shall make as many inspections as necessary during the guarantee period, at no
additional cost to the Owner, to evaluate the condition of all plant material. Contractor shall
submit a written report of each inspection to the Owner and the Landscape Architect outlining
corrective measures required in order to keep the guarantee valid.

C. At the end of the guarantee period plants shall be healthy, vigorous, and free of pests, diseases,
nutritional deficiencies, dieback, stress, or decline.

D. Contractor shall replace dead plants and all plants not in a vigorous, thriving condition, as
determined by the Landscape Architect, before the end of the guarantee period, without cost to the
Owner, as soon as weather conditions permit and within the specified planting period.
1.
