It may also obtain any other pertinent information deemed desirable or <br />necessary . <br /> <br />PROCEDURES FOR THE REVIEW AND DETERMINATION OF RESPONSffiILITY FOR <br />FAULT: <br /> <br />A. A determination of fault by the Board shall be made on the basis that a person is judged to <br />be the major contributing factor, which resulted in the accident. The Board shall specifically <br />address the possibility that: <br /> <br />1. The employee could have prevented the accident. <br />2, The supervisor or the City could have prevented the accident. <br />3. That equipment failure or the environment was primarily responsible. <br /> <br />The Board may determine that no person is the major contributing factor, in which case the Board <br />shall try to determine what combination of factors led to the accident. The Board shall begin the <br />review of each accident by identifying themselves and the purpose for the review. The employee <br />shall be asked to describe the accident and include any circumstances that may have contributed to <br />its cause. The employee may testify on hislher own behalf or produce witnesses or facts in support <br />ofhis/her position. The Board may, at any time, call such other witnesses, as it may deem necessary <br />for a full understanding of the case. All voting shall be by voice vote and open ballot. The final <br />decisions of the Board shall be documented and submitted to the employee and City Manager. <br /> <br />APPEAL: <br /> <br />The employee shall have the right to appeal the final decision of the Board through the chain of <br />command or, when applicable, to the City Manager. <br /> <br />DISCIPLINARY ACTION FOR EMPLOYEES FOUND TO BE AT FAULT: <br /> <br />A. Explanations and Definitions: <br /> <br />Disciplinary actions for accidents where the employee is found to be at fault will be categorized as <br />minor or major accidents. A major accident is defined as one involving $2,000.00 or more in total <br />property damage and/or causing bodily injury to any person as a result of such accident. <br /> <br />Disciplinary action shall be based upon the date of the most recent accident and the employee's <br />record for the preceding 24 months period for accidents. <br /> <br />All disciplinary actions listed 2 and 3 can be lessened or exceeded by the City Manager at his sole <br />option. <br /> <br />Page 2 of 3 <br />
