Notwithstanding the forgoing the F.A.R. shall not exceed the allowable limits <br /> <br />set under the Comprehensive Master Plan and/or Land Use Plan, if any. <br /> <br />(a) Beach and Bay Access Bonus: A floor area ratio bonus shall be given for <br /> <br />developments abutting the bay or ocean where improved land or easements are <br /> <br />dedicated or granted to the City and accepted by the City Commission or Director <br /> <br />for public access. For the purposes ofthis section, "improved" means landscaped, <br /> <br />lighted and irrigated in a manner consistent with the adjoining development and <br /> <br />including a paved accessway and pedestrian amenities. For the purposes of this <br /> <br />section, "public access" means unencumbered and unrestricted access to the <br /> <br />public: except however, that upon request of the grantor or property owner, the <br /> <br />City Commission may accept a restriction upon the grant or dedication limiting <br /> <br />the hours of general public access to daylight hours, provided that the City shall <br /> <br />have unrestricted access for fire and police protection and provided that the <br /> <br />grantor or property owner shall bear the full expense of installing a gate always <br /> <br />accessible to police and fire protection personnel and equipment. Said areas are <br /> <br />to extend the full length of the property from the street most nearly parallel to the <br /> <br />mean high water line, to the ocean or bay and shall be a minimum of ten (10) <br /> <br />percent of the frontage of the property but not less than 25 feet in width (except <br /> <br />that lots with 120 feet of frontage shall provide a minimum of 20 feet of public <br /> <br />beach access easement.) Such areas shall continue to be included in density, <br /> <br />view corridor, open space and setback calculations. The bonus shall be an <br /> <br />additional F.A.R. of five one-hundredths (0.05)for the dedication of the minimum <br /> <br />beach access described above.
