Landlord is not & shall not be, throughout the lease term and any extensions of it, <br />responsible to maintain the premises, any structures, improvements thereon or fixtures thereto. <br /> <br />All maintenance, repairs, and replacements, struchlral, cosmetic, aesthetic or otherwise, <br />are the sole responsibility of Ten ant and must be promptly performed when required by the <br />Landlord or any governmental or quasi-governmental authority. <br /> <br />Landlord's Failure To Repair or Maintain <br /> <br />9 4.02. If Tenant fails to perform its obligation to repair, replace, or maintain, as set forth <br />in 9 4.01 above, within a reasonable time after notice from Landlord of the need for the repair, <br />replacement, or maintenance, Landlord may make the repairs or replacements, or perform the <br />maintenance, or have the repairs or replacements made or maintenance performed, at its own <br />expense and may add such sums to the next monthly rental payment due from Tenant <br /> <br />Environmental Cleanup Costs <br /> <br />9 4.03. Tenant is responsible for the payment of any cleanup costs necessary for <br />compliance with Hazardous Materials Laws that arise as a result of the Tenant's, or any person <br />in or about the premises with Tenant's express or implied consent, discharge of hazardous <br />materials on the premises during the Tenant's occupancy of the premises. <br /> <br />ARTICLE 5 <br />UTILITIES, GARBAGE REMOVAL AND T A.,,,(ES <br /> <br />Utility Charges <br /> <br />S 5.01. Tenant will pay all utility charges tor water, electricity, and gas used in and about <br />the premises during the lease term. <br /> <br />Garbage Removal <br /> <br />~ 5.02.
