Truck Certification <br />Fuel delivery shall be in trucks equipped with a sealed State of Florida approved and inspected meter or that <br />have State of Florida Department of Agriculture and Consumer Services sealed, calibrated, and certified <br />compartment tank volume markers for the petroleum product being delivered. <br /> <br />9. Addition or Deletion of Facilities <br />The County, at its sole discretion, may add or delete facilities or service for any facility. When the need arises, <br />the County will add or delete facilities to the master list (Attachment A) and notify the Contractor in writing. <br /> <br />10. Emeraency Continaency Plan <br />The Contractor shall, at all times, have an Emergency Contingency Plan that guarantees the County a <br />continuous supply of fuel before, during, and after an emergency, as determined solely by the County. During <br />emergencies the County has historically experienced an increase in its normal fuel purchases of about 40%- <br />60% for a period of time depending on the nature of the emergency. The Contractor shall provide the fuel at <br />existing contract prices. If the need arises, the County will reimburse the Contractor for fuel delivered from <br />ports or terminals other than Port Everglades, with prior written approval from the County, in accordance with <br />Appendix B, Price Schedule. <br /> <br />11. Fuel Spills <br /> <br />A. The Contractor shall be fully responsible for any and all actions of their employee's, including <br />those that require abatement or clean up as result of an "improper" delivery. The Contractor <br />shall have and shall maintain those types and~uantities of materials necessary to contain a fuel <br />spill. I <br /> <br />B. The Contractor shall promptly, and thoroughly cleanup all fuel spills. pursuant to federal, state, <br />and local regulations and shall pay for any environmental remediation and any agency fines or <br />fees that result from, the fuel spill. <br /> <br />C. Discovery or occurrence of a fuel spill, on overfill, excess water in the tank, suspected <br />contamination of surrounding area, suspected tank failure, or any indication of chemical release <br />shall be immediately reported by the Contractor to the County. When the event is directly or <br />indirectly the result of the Contractor's actions, the Contractor shall also effect containment and <br />initiate cleanup immediately. <br /> <br />12. Accident Prevention and Barricades <br />The Contractor shall exercise precautions at all times for the protection of persons and property. The <br />Contractor during the provision of services shall conform to all relevant Federal, State and County regulations. <br />Any fines-levied by the above-mentioned authorities for failure to comply with these requirements shall be <br />borne solely by the Contractor. The Contractor shall provide barricades - when fuel delivery is performed in <br />areas traversed by persons, or when deemed necessary by an authorized County representative. <br /> <br />13. Compliance with Federal Standards <br />The handling and delivery of all fuel during the provision of services shall be in accordance with all <br />governmental standards, to include, but not be limited to, those issued by the Occupational Safety and Health <br />Administration (OSHA), the National Institute of Occupational Safety Hazards (NIOSH), the National Fire <br />Protection Association (NFPA), and the EPA. <br /> <br />3 <br /> <br />s\~ <br />
