<br />Proposer will contract with the Newport Beachside Hotel and Resort for valet services for the <br />Restaurant. The total number of spaces is approximately 200. <br /> <br />6. The restroom will be built out and maintained by the selected Proposer but will be for the <br />benefit of Pier patrons and City employees as well. <br /> <br />7. The City will provide to the selected Proposer a completed shell with stub out of plumbing <br />and electrical. <br /> <br />3. Operation Phase <br /> <br />A. Management and Operation Services and Foodservice <br /> <br />The selected Proposer shall operate the Restaurant and related activities in a manner associated <br />with high quality foodservice standards. The selected Proposer shall provide the following <br />servIces: <br /> <br />B. Management and Operation Services <br /> <br />1. The selected Proposer will have utilization of the Restaurant area as shown on Attachment <br />"E". The Pier is open and subject to uncontrolled entry twenty-four hours a day, seven days <br />a week. The selected Proposer shall secure the Restaurant and provide twenty-four (24) hour <br />protection service. The City will not accept any responsibility for the loss or damage of the <br />selected Proposer's equipment or supplies. <br /> <br />2. The Restaurant shall have a family atmosphere and may have live entertainment. At no time <br />may the Restaurant operate as a night dub, as determined by the City. <br /> <br />3. The selected Proposer's staff shall be distinctively uniformed so as to be distinguishable as <br />the selected Proposer's staff and not as employees of the City. <br /> <br />4. The selected Proposer shall take good care of the Restaurant and shall use the same in a <br />careful manner. The selected Proposer shall, at its own cost and expense, repair City <br />property damaged by the selected Proposer's operations. <br /> <br />5. The walkways leading up to and around the Restaurant shall be properly maintained by the <br />selected Proposer. <br /> <br />6. The selected Proposer will be responsible for the proper maintenance of the Pier and <br />Bait/Gift Shop if Proposer chooses to operate those under this agreement. <br /> <br />7. The City shall be given special pricing and consideration when using the Restaurant and <br />selected Proposer for City sponsored Special Events at the Pier, up to four (4) events per <br />year. <br /> <br />8. The selected Proposer shall furnish high quality, prompt and efficient service, adequate to <br />meet all reasonable demands, including establishing minimum schedule and hours of <br />operation, subject to approval by the City. <br /> <br />9. The selected Proposer shall provide an operation that will be safe, customer oriented with <br />prompt service, complaint resolution, effective employee performance and training and <br />timely initiation and completion of all work. <br /> <br />10. The selected Proposer shall be diligent in ensuring the safety of the patrons of the Restaurant <br />by conducting official national background checks on all owners, employees, and volunteers <br /> <br />5 <br />
