<br />City of Sunny Isles Beach | Invitation to Bid No. 16-12-02 16 <br /> <br />or another contractor and any such costs incurred will be deducted from any sums due <br />the Contractor under any contract with the City. <br /> <br />2.19 FURNISH AND INSTALL REQUIREMENTS <br />The specifications and/or statement of work contained within this solicitation describe the various <br />functions and classes of work required as necessary for the completion of the work. Any omissions <br />of inherent technical functions or classes of work within the specifications and/or statement of work <br />shall not relieve the Contractor from furnishing, installing or performing such work where required <br />to the satisfactory completion of the project. <br /> <br />2.20 LICENSES, PERMITS AND FEES <br />The Contractor shall obtain and pay for all licenses, permits and inspec tion fees required for this <br />project; and shall comply with all laws, ordinances, regulations and building code requirements <br />applicable to the work contemplated herein. Damages, penalties and or fines imposed on the City <br />or the Contractor for failure to obtain required licenses, permits or fines shall be borne by the <br />Contractor. <br /> <br />2.21 LIQUIDATED DAMAGES FOR INCOMPLETE PROJECTS <br />The Contractor is obligated and guarantees to complete the Project in the time set forth in the <br />Contract or any approved extension of time the Contractor may be granted by the City Manager. <br />The Contractor will be notified in writing of any approved exceptions or extensions by the City <br />Manager. Failure to complete the project in accordance with the specifications and to the <br />satisfaction of the City within the time stated for substantial and/or final completion shall cause the <br />Contractor to be subject to charges for liquidated damages for each and every calendar day the <br />work remains incomplete beyond these deadlines. The liquidated damages amounts are as follows: <br /> <br />Original Contract Amount Daily Charge Per Calendar Day <br /> <br />$250,000 but less than $500,000 .................................................................................... $1,074 <br />$500,000 but less than $2,500,000 ................................................................................. $1,742 <br /> <br />As compensation due to the City for loss of use and for additional costs incurred by the City due to <br />such non-completion of the work, the City shall have the right to deduct the said liquidated <br />damages from any amount due, or that may become due to the Contractor under this agreement, <br />or to invoice the Contractor for such damages if the costs incurred exceed the amount due to the <br />Contractor. <br /> <br />2.22 FRAUD AND MISREPRESENTATION <br />The City may terminate this Contract based on any attempt by the Contractor to meet its <br />contractual obligations with the City through fraud, misrepresentation or material <br />misstatement. Should this occur the Contractor will be responsible for all direct or indirect costs <br />associated with termination or cancellation of the Contract. <br /> <br />
