<br />City of Sunny Isles Beach |Request for Proposal No. 17-04-01 16 <br /> <br />responsible for installation, calibration, and testing the Kiosks and ensuring proper functionality <br />prior to general public use. The selected Proposer must perform all implementation/installation <br />services in selected location(s). All implementation services shall be coordinated through the <br />authorized City’s IT project manager. <br /> <br />3.7 SOFTWARE MAINTENANCE AND SUPPORT SERVICES <br /> <br />The selected Proposer shall provide all software maintenance support services for the Kiosks, <br />throughout the term of the contract, including any optional renewal periods. At a minimum, <br />maintenance services shall include updates and upgrades to the Kiosk. Maintenance Services on <br />the software shall include corrections of any substantial defects, fixes of any minor bugs, and fixes <br />due to any conflicts with mandatory operating system security patches as well as upgrades to new <br />version releases. All environments, production and non-production, including testing and staging <br />shall also be covered under Maintenance Services. Maintenance Services must be provided via <br />Remote Services using virtual private network (VPN) access or in person. <br /> <br />3.8 TECHNICAL SUPPORT SERVICES <br /> <br /> The selected Proposer shall be responsible for providing on-site and on-call technical support <br /> services to ensure optimal performance of the proposed kiosks, including all hardware and software <br /> components. This should include remote diagnostic tools to detect and correct application errors <br /> in the software component. All alerts or error notifications shall be sent to the City’s IT Helpdesk. <br /> <br />3.9 WARRANTY <br /> <br /> A. Type of Warranty Coverage Required <br /> <br />In addition to all other warranties that may be supplied by the Proposer, the bidder shall warrant <br />its products and/or service against faulty labor and/or defective material, for a minimum period <br />of one (1) year after the date of acceptance of the labor, materials and/or equipment by the City <br />Commission. This warranty requirement shall remain in force for the full one (1) year period; <br />regardless of whether the bidder is under contract with the City at the time of defect. Any <br />payment by the City on behalf of the goods or services received from the bidder does not <br />constitute a waiver of these warranty provisions. <br /> <br /> B. Correcting Defects Covered Under Warranty <br /> <br />The Proposer shall be responsible for promptly correcting any deficiency, at no cost to the City, <br />within one (1) calendar day after the City notifies the Proposer of such deficiency in writing. If <br />the Proposer fails to honor the warranty and/or fails to correct or replace the defective work or <br />items within the period specified, the City may, at its discretion, notify the Proposer, in writing, <br />that the Proposer may be debarred as a City bidder and/or subject to contractual default if the <br />corrections or replacements are not completed to the satisfaction of the City within five (5) <br />calendar days of receipt of the notice. If the Proposer fails to satisfy the warranty within the <br />period specified in the notice, the City may (a) place the Proposer in default of its contract, <br />and/or (b) procure the products or services from another vendor and charge the Proposer for any
