3. Eligible employees with an immediate family member or next of kin recovering from <br /> a serious illness or injury sustain in the line of active duty can qualify for up to 26 <br /> weeks of leave in a 12-month period. <br /> DEFINITION/APPLICATION: <br /> 1. Spouse means a husband or wife as defined or recognized in the state where the <br /> individual was married and includes individuals in a same-sex marriage or common <br /> law marriage. <br /> 2. Registered Domestic Partner means one of two adults who are parties to a valid <br /> domestic relationship as established pursuant to section 11A-72 of the Miami- <br /> Dade County Code. <br /> 3. Parent means a biological, adoptive, step or foster parent or an individual who <br /> stands or stood in loco parentis to an employee when the employee was a child. <br /> Parent for FMLA purposes does not include in-laws. <br /> 4. Grandparent means a biological, adoptive, or step grandparent for whom the <br /> employee has assumed primary financial responsibility. <br /> 5. Child means a biological, adopted or foster child, a stepchild, a legal ward, or a <br /> child of a person standing in loco parentis. For purposes of FMLA taken for <br /> adoption of a child or to care for a child with a serious health condition, the child <br /> must be under age 18 or age 18 or older and incapable of self-care because of a <br /> mental or physical disability. For purposes of FMLA taken to care for a covered <br /> servicemember with a serious injury or illness, or because of a qualifying exigency, <br /> the child may be of any age. <br /> 6. Incapable of self-care means that the individual requires active assistance <br /> or supervision to provide daily self-care in several of the activities of daily living <br /> (e.g., grooming and hygiene, bathing, dressing, eating, cooking, cleaning, <br /> shopping, taking public transportation, paying bills, maintaining residence, using <br /> telephones and directories, using a post office, etc.) <br /> 7. Foster care means twenty-four (24)-hour care for children in substitution for, <br /> and away from, their parents or legal guardians. Such placement with the family <br /> for the child's care is made by or with the agreement of the state. <br /> 8. Physical or mental disability means a physical or mental impairment that <br /> substantially limits one or more of the major life activities of an individual. <br /> 9. In Loco Parentis refers to a person who has put himself in the situation of a <br /> lawful parent by assuming the obligations incident to a parental relationship <br /> without going through the formalities of legal adoption. It includes assuming <br /> parental status and discharging parental duties such as individuals with day-to- <br /> 704:2 FMLA Page 2 of 19 <br /> 113 <br />
