day responsibilities to care for and financially support a child either now as an <br /> employee, or who had such responsibility when the employee was a child. A <br /> biological or legal relationship is not necessary. <br /> 10.Next of kin means the nearest blood relative other than the covered service <br /> member's spouse, parent or child. A covered servicemember may designate a <br /> blood relative as next of kin. <br /> 11.Serious Injury or illness means, under Military Caregiver leave, that which <br /> may render the servicemember medically unfit to perform duties of his/her <br /> office, grade, rank or rating. <br /> 12.Serious health condition means an illness, injury, impairment or physical or <br /> mental condition that involves: <br /> a. Inpatient care (i.e., an overnight stay) in a hospital, hospice or residential <br /> medical care facility, including any period of incapacity (for purposes of this <br /> section defined to mean inability to work, attend school or perform other <br /> regular daily activities due to the serious health condition, treatment for or <br /> recovery from), or any subsequent treatment in connection with such <br /> inpatient care; or <br /> b. Continuing treatment by a health care provider. <br /> 13.Continuing treatment by a health care provider means one or more of <br /> the following: <br /> a. A period of incapacity (i.e., inability to work, attend school or perform other <br /> regular daily activities due to the serious health condition, treatment for or <br /> recovery from) of more than three (3) consecutive calendar days, and any <br /> subsequent treatment or period of incapacity relating to the same condition, <br /> that also involves: <br /> b. Treatment two (2) or more times by a licensed health care provider, by <br /> a nurse or physician's assistant under supervision of a another health <br /> care provider, or by a provider of auxiliary health care services (e.g., <br /> physical therapist) pursuant to orders or referral by a licensed health care <br /> provider; or <br /> c. Treatment by a licensed health care provider on at least one occasion <br /> which results in a regimen of continuing treatment under his or her <br /> supervision. <br /> d. Any period of incapacity due to pregnancy or prenatal care. <br /> e. Any period of incapacity or treatment for such incapacity due to a chronic <br /> serious health condition.
