f. Requires periodic visits for treatment by a licensed health care provider or <br /> by a nurse or physician's assistant under his or her supervision; <br /> g. Continues over an extended period of time including recurring episodes <br /> of a single underlying condition; and <br /> h. Causes episodic rather than permanent incapacity (e.g., asthma, <br /> diabetes, epilepsy, etc.) <br /> i. A period of incapacity, which is permanent or long-term due to a condition <br /> for which treatment may be effective. The employee or family member <br /> must be under the continuing supervision of, but need not be receiving <br /> active treatment by, a health care provider. Examples include <br /> Alzheimer's, a severe stroke or the terminal stages of a disease. <br /> j. Any period of absence to receive multiple treatments (including any <br /> period of recovery) by a licensed health care provider or pursuant to <br /> orders or referral from another licensed health care provider, either for <br /> restorative surgery after an accident or other injury, or for a condition <br /> that would likely result in a period of incapacity of more than three <br /> consecutive calendar days in the absence of medical intervention or <br /> treatment such as cancer (chemotherapy, radiation, etc.), severe arthritis <br /> (physical therapy), and kidney disease (dialysis). <br /> 14. Licensed health care provider means: <br /> a. A doctor of medicine or osteopathy authorized to practice medicine or <br /> surgery by the state in which the doctor practices, <br /> b. A podiatrist, dentist, clinical psychologist, optometrist, or chiropractor (with <br /> limitations) authorized to practice in the state and performing within the <br /> scope of his or her practice; <br /> c. A nurse practitioner, nurse-midwife, clinical social worker, or physician <br /> assistant authorized to practice in the state and performing within the scope <br /> of his or her practice; <br /> d. A Christian Science practitioner listed with the First Church of Christ, <br /> Scientist, in Boston, Massachusetts; or <br /> e. Any health care provider from whom the employer or the employer's group <br /> health plan's benefits manager will accept a medical certification to <br /> substantiate a claim for benefits. <br /> 15.Equivalent position means a position with the same pay, benefits and working <br /> conditions, including privileges, perquisites and status, which involves the <br /> same or substantially similar duties and responsibilities, and entails equivalent <br /> skill, effort, responsibility and authority.
