Employees 411 Alpine Towing will be responsible for selecting, training and employing (or otherwise retaining) personnel as is necessary to satisfy the requirements of this contract to satisfactorily perform all work and services described herein. o Alpine Towing will perform driver's license screening on all employees with driving responsibilities and a copy of each license will be kept on file and made available upon request by the City Manager or designee. o Alpine Towing represents that every driver operating a tow truck possesses a valid license, for all Class "A" or Class "B" wreckers with a GVW less than 26,000 GVW, or a CDL endorsement for operating a Class "C", Class "D",wrecker or Landoll which requires a CDL endorsement. o Each Alpine Towing Employee (driver or office staff) is required to wear an Alpine Towing uniform or shirt while performing daily duties. o Alpine Towing performs drug test screening on all employees and will provide pass/fail results to the City Manager or designee, upon request. All employees and/or other individuals retained by Alpine Towing, shall not, for any purposes, be employees of the City of Sunny Isles Beach, Alpine Towing shall be responsible for their daily supervision, direction and control. Complaints and Disputes 0 Alpine Towing understands that all complaints will be forwarded to the contract manager. If the incident requires formal investigation, Alpine will be notified of the complaint by certified mail. Alpine Towing shall have seven (7) days to respond in writing to the complaint. After the investigation is completed, a memo will be forwarded to the Chief of Police regarding the outcome. If the complaint is sustained, a recommendation of disciplinary action will be forwarded to the Chief of Police. Alpine Towing agrees that any complaint received by the City concerning misconduct on its part, such as excessive charges, poor business practices, damages to vehicles, etc., that cannot be resolved with the Police Chiefs designee, will be returned to the Police Chief's office for appropriate action, including contract termination. If the complaint is not amicably resolved top the satisfaction of the Police Chief or vehicle owner, it may be refereed to the City Manager's office. Private Commercial Towing Companies Alpine Towing understands that the City has the right to waive awarding bids from towing companies contracted to tow for private commercial businesses within the City limits of Sunny Isles Beach due to conflicts of interest. Non-Exclusive Services Alpine Towing understands that nothing contained in this contract will prevent the vehicle owner or operator of a motor vehicle from calling a wrecker or tow truck of their choice, or requesting that their vehicle be towed to a garage or location or compound of his/her choice and not that of Alpine Towing, unless the disabled vehicle cannot be removed within forty (40) minutes or less, is creating a tie up of traffic or hazardous situation, in the 0 opinion of the on-scene officer.
