City of Sunny Isles Beach 18070 Collins Avenue, Sunny Isles Beach, Florida 33160 <br /> - (305) 947-0606 phone (305)949-3113 Fax <br /> "A person or affiliate who has been placed on the convicted vendor list following a <br /> conviction for a public entity crime may not submit a bid on a contract to provide any <br /> goods and services to a public entity, may not submit a bid on a contract with a'public <br /> entity,for the construction or repair of a public building or public work, may not submit <br /> bids on leases of real property to a public entity, may not be awarded or perform work as <br /> a contractor, supplier, subcontractor, or consultant under a contract with any public entity, <br /> and may not transact business with any public entity in excess of the threshold amount <br /> provided in Section 287.017,for CATEGORY TWO for a period of 36 months from the <br /> date of being placed on the convicted vendor list." <br /> 16.6 Unauthorized Aliens: <br /> The City shall consider the employment by any contractor of unauthorized aliens a <br /> violation of section 274A(e) of the Immigration and Nationalization Act. Such violations <br /> shall be cause for unilateral cancellation of this contract. <br /> 16.7 Ownership of Documents: <br /> The parties agree that all documentation and work product produced pursuant to this <br /> Agreement shall become the exclusive property of the City and shall be provided to the <br /> City upon request. <br /> 16.8 Indemnification and Waiver of Liability: <br /> The Architect agrees to indemnify and hold harmless the Owner, its representatives, <br /> officers, directors, officials and employees from and against claims, damages, losses and <br /> expenses (including but not,limited to reasonable attorney's fees and costs) to the extent <br /> the same are caused by the Architect's negligent acts,errors,mistakes or omissions relating <br /> to professional services in the performance of this Agreement. <br /> The Architect and Owner waive consequential damages for claims, disputes or other <br /> matters in question arising out of or relating to this Agreement. This mutual waiver is <br /> applicable, without limitation, to all consequential damages due to either party's <br /> termination of this Agreement,except as specifically provided in Article 11. <br /> 16.9 Insurance Requirements: <br /> The Architect shall maintain during the terms, except as noted, of this Agreement the <br /> following insurance: <br /> A. Professional Liability Insurance in the amount of One Million Dollars <br /> ($1,000,000.00 per claim and aggregate), which shall be the limit of liability <br /> 6009-062 PERKINS&WILL ARCHITECTS INC. 23 <br />
