It is <br /> the intention of the Owner to use electronic communication whenever possible for all <br /> projects. When possible, plans and specifications for review purposes will also be' <br /> transmitted electronically to the Owner. The Architect shall provide its electronic mail <br /> address and a name of a point of contact for electronic communications. <br /> 16.11 Hazardous Materials Disclaimer: <br /> Architect and Architect's consultants shall have no responsibility for the discovery, <br /> presence,handling or removal or disposal or exposure of persons to hazardous materials or <br /> wastes in any form at the Project site, including but not limited to asbestos, asbestos <br /> products, polychlorinated biphenyl(PCB) or other toxic substances. <br /> 16.12 Incorporation of Bid Response into the Contract: - <br /> The contents of the Architect Engineer's Response to Request for Qualifications ("RFQ") <br /> No. 17-12-01 shall be incorporated into this Agreement. <br /> 16.13 No Personal Liability: - <br /> Pursuant to Florida Statutes Section 558.0035(1)(c), an individual, <br /> employee, or agent may not be held individually liable for <br /> negligenceoccurring within the course-and scope of this Agreement. <br /> Pursuant to Florida Statutes Section 558.0035(1)(c), an individual, <br /> employee, or agent may not be held individually -liable for <br /> negligence occurring within.the course and scope of this Agreement <br /> provided the damages are solely economic in nature and the <br /> damages do not extend to personal injuries or property not subject <br /> to the contract. <br /> 16.14 No Third Party Beneficiaries: <br /> No person or entity other than the Owner is intended to be a beneficiary of Architect's <br /> services under this Agreement and contractor shall have no right to maintain any action in <br /> contract, tort or otherwise directly against the Architect. <br /> 16.15 PUBLIC RECORDS.
